th Services The Emancipation Process LARY If you read last week's 'article and feel that you meet all the criteria for emancipation and still want to proceed, then there are a few simple steps to follow. 1. First you must go to the County Clerks office in Santa Rosa at 2555 Mendocino Avenue. The phone number is 527-2611. You need to go there to pick up two forms: the Petition for Eman- cipation and The Declaration of Eman- cipation. These forms will cost you 50 cents each. 2. Next you must fill out the petition and have your parents sign the waiver. Remember, parents must approve the petition. If your parents will NOT sign, or cannot even be con- tacted, your case becomes more difficult and you really should consult a lawyer. 3. After you have filled out all necessary forms, gotten your parents signature on the waiver, you are ready . to return the forms to the County lerks office to "file the petition." At this time a hearing date will be set for anywhere from one to three weeks in the future. There is a $52 filing fee. 4. You must appear at the hearing. Your parents need not appear, but they must have been notified of the hearing. The judge will read your petition, ask you questions to verify the facts you have set forth in the petition, and he will have some questions for your parents if they are present. "A judge closely examining the issue will probably want to know bow the minor intends to support himself or herself until 18. and the minor would be well advised to have sensible answers to this question. The judge will grant the petition if he finds that the facts alleged in the petition are true, and that emancipation will not be contrary to the minor's best interest." The petition can be granted even if parents are absent. 5. Appeal: If the jqjdge does not grant your petition you may appeal. 6. If approved, the judge will sign a declaration of emancipation and you will be given a copy to keep with you as proof of your new status. You may then apply to the Department of Motor Vehicles for an ID card stating that you are emancipated. 7. Rescinding Eman- cipation: The declaration of emancipation may be rescinded through another petition to the court requesting such action. A declaration can be rescinded by the minor if he or she feels they cannot make it on their own and has no means of support. Petitions to rescind a declaration of emancipation can also be filed by your parents or some other person or agency on the Wednesday- December 17, 1980 Page 13 basis of fraud.
