PUBLIC NOTICE PUBLIC NOTICE ORDINANCE NO 667-2009 AN ORDINANCE OF THE CITY OF CLOVERDALE, CALIFORNIA, AMENDING SECTION 2.36.060 OF THE CLOVERDALE MUNICIPAL CODE TO IN- CREASE THE NUMBER OF ALTERNATE PLANNING COMMISSION MEMBERS FROM ONE TO TWO MEMBERS PUBLIC NOTICE RECITALS: WHEREAS, the Cloverdale Municipal Code Chapter 2.36 pro- vides for establishment of a Planning Commission, powers and duties of Commissioners, and provision for alternate Commis- sion members, and WHEREAS, Section 2.36.060 provides for appointment of one resident alternate Commissioner, and WHEREAS, the Commission recently experienced several meet- ings where there were four members available to attend, includ- ing the alternate Commissioner, and WHEREAS, the City Council has determined that a second alternate Commissioner would have allowed the Commission to function with five voting members, and WHEREAS, the City Council has determined that the alternate Commissioner will retain a pool of experienced potential Plan- ning Commission members. SERVICES NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF CLOVERDALE, CALIFORNIA, DOES HEREBY ORDAIN AS FOLLOWS: Section 1. g$;:iion 2]:3~i060 of the Cloverdale MUnicipai Code is hereby amended as follows: 2.36.060 Alternate member. In addition to the five regular members, the mayor, with the approval of the city council, shall appoint two resident alternate commissioners for a term of two years, who shall have all of the powers and duties of a regular commissioner except his or her right to vote shall be allowed and have legal effect only when seated as an acting commissioner in the absence of one of the regular commis- sioners. The position of acting commissioner shall be rotated between the alternate commissioners. RENTALS HELP WANTED Section 2 Severance Clause. The City Council declares that each section, subsection, paragraph, subparagraph, sen- tence, clause, and phrase of this Ordinance (singularly and collectively referred as "provision" and "provisions," respec- tively) is severable and independent of every other provision of this Ordinance. If any provision of this Ordinance is held to be invalid, the City Council declares that it would have adopted the remaining provisions of this Ordinance irrespec- tive of the provision or provisions held invalid, and further declares its express intent that the remaining provisions of this Ordinance should remain in effect after the invalid provision has been eliminated. Section 3 Effective Date. This Ordinance of the City of CIoverdale shall be effective thirty (30) days from and after the date of its passage. Before the expiration of fifteen (15) days after its passage, this Ordinance, or a summary thereof, as provided in California Government Code 36933, shall be published in a newspaper of general circulation published and circulated within the City of CIoverdale.
